Employment barrister Ian Neil SC said the biggest issues would be workers who refuse to be vaccinated for medical reasons, religious beliefs or because they believed in conspiracy theories. “Employers should be thinking about this now and talking to employees about vaccination now,” he said.
A workplace law expert says employers will have the right to sack a worker who refuses to get the COVID vaccination except in some circumstances. Employer groups and unions say public education campaigns will be a key to the smooth and widespread roll-out of the vaccination program.
Barrister Ian Neil SC and RMIT University academic Anthony Forsyth said employers had the power to issue “lawful and reasonable” directions that could be used to compel staff to get vaccinated, but the law had not been tested in court for that purpose.
